These Terms and Conditions (hereinafter "Terms"), including any additional terms, policies or documents referenced herein and/or available by hyperlink, govern your use of the Thunder website (hereinafter the "Website" or “Site”) and the purchase of products or services from Thunder Energy Services LLC (hereinafter "Thunder", "we", "us", or "our"). These Terms will also apply to any purchase of our products placed through third-party e-commerce platforms.

Please read them carefully before using the Website or placing an order. By accessing or using any part of the website, you agree to be bound by these Terms. If you do not agree to all the terms and conditions forth herein, then you may not access the website or use any services. If these Terms are deemed an offer, acceptance is expressly limited to these Terms. Please save or print responsibly these Terms for your records. 

 

You can review the most current version of the Terms at any time on this site. We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this site periodically for such changes. Your continued use of or access to the website following the posting of any changes constitutes your acceptance of those changes.

 

These Terms form an integral part of the Website Terms of Use, which govern your general use of our site. You are also encouraged to carefully review our Privacy Policy before placing any order for products or services through the website (see Section 13).

2. Our Products

  1. The images of the products displayed on our Website are for illustrative purposes only. While we make every effort to display products accurately, we cannot guarantee that your device’s display of any colour will precisely reflect the actual colour of the products. Accordingly, the products you receive may differ slightly in appearance from those images.
     

  2. Although we strive for accuracy, all sizes, weights, capacities, dimensions, and measurements listed on our Website are approximate and may vary within a tolerance of up to 2%.
     

  3. Product packaging may differ from that shown in any images on the Website.
     

  4. All products displayed on the Website are subject to availability. If a product you have ordered is unavailable, we will notify you via email as soon as reasonably practicable, and your order will not be processed.

3. Prices and Payment Terms

  1. All prices listed on this Website are subject to change at any time without prior notice. The price charged for any product or service will be the price in effect at the time your order is placed and will be specified in the order confirmation email. Any price changes will apply only to orders placed after the effective date of such changes. We are not responsible for pricing, typographical, or other errors in any offer or listing, and we reserve the right to cancel any orders resulting from such errors, whether or not the order has been confirmed or payment has been received.
     

  2. Payment terms are within our sole discretion and, unless otherwise agreed by us in writing, full payment must be received prior to our acceptance of your order. We accept the payment methods specified in our Payment Policy, which may be updated from time to time. By submitting payment information, you represent and warrant that:
     

  • the payment information you provide is accurate, complete, and current;

  • you are duly authorised to use the payment method provided;

  • all charges incurred by you will be honored by your payment provider;

  • you agree to pay all charges at the prices in effect at the time of your order, including any applicable taxes.
     

4. Shipping and Delivery

For additional information, please refer to the Thunder Energy Services LLC Shipping Policy. All shipping and delivery dates provided are estimates only and are not guaranteed. Thunder Energy Services LLC shall not be held liable for any delays in shipment or delivery, regardless of the cause. Risk of loss and title for products pass to you upon our delivery to the carrier.

6. Limited Warranty

7. Regulatory Compliance

Whether you choose to install the product yourself or engage a qualified professional, all electrical installation work must comply with applicable UK legislation and standards. This includes, but is not limited to:

 

  1. BS 7671:2018+A2:2022 (IET Wiring Regulations), particularly Regulations 411 (protection against electric shock), 433 (overcurrent protection), 462 and 537 (isolation and switching), 712 (solar photovoltaic systems), and Chapter 82 (prosumer installations);

  2. The IET Code of Practice for Grid-Connected Solar Photovoltaic Systems (3rd Edition), covering requirements for cable sizing, grid connection, anti-islanding protection, and battery system integration;

  3. Approved Document P of the Building Regulations 2010 (Electrical Safety – Dwellings), including relevant notification requirements and the need for work to be carried out by a Competent Person Scheme (CPS) registered electrician where applicable;

  4. ENA Engineering Recommendation G98/1-8 (2021), concerning the connection of microgeneration systems (≤16 A per phase) to the public distribution network.

 

Any alterations to your property’s wiring—such as connecting a microinverter, modifying a consumer unit, or installing an isolator—must be completed either by an electrician registered under a recognised Competent Person Scheme, or must be notified to your local Building Control body prior to the commencement of works.

 

If you elect to carry out the installation yourself, it is your sole responsibility to ensure full compliance with all applicable legal and safety requirements. This includes, where required, undertaking all necessary commissioning tests (such as RCD testing, earth fault loop impedance testing, and anti-islanding verification) and notifying your local Distribution Network Operator (DNO) within 28 days of commissioning, in accordance with ENA G98, where applicable.

 

All relevant documentation—such as the Electrical Installation Certificate, Building Regulations Compliance Certificate, and commissioning test records—must be properly completed and retained.

 

Thunder Energy Services LLC shall not be liable for any damage, regulatory non-compliance, or safety risk arising from incorrect, incomplete, or unauthorised installation.

8. Suitability of Property and Electrical Supply

Before installing your solar kit, it is essential to ensure that your property is suitable for the installation. This includes verifying that your existing electrical supply infrastructure is capable of safely accommodating the additional energy generated by the system. You must also assess the intended installation area—whether a balcony, terrace, patio, garage, or garden space—to confirm that it is structurally sound and capable of supporting the weight of the equipment.

 

If any structural modifications or reinforcements are necessary to comply with applicable safety or building regulations, it is your sole responsibility to arrange for and complete such works prior to installation.
 

9. Planning Permission

The customer is solely responsible for determining whether planning permission is required for the installation of the system. In cases of uncertainty, the customer should consult their local planning authority or refer to the UK Government’s Planning Portal (https://www.gov.uk/planning-permission-england-wales) guidance.
 

10. Installation Risk and Liability
All installations are undertaken at the customer’s own risk. Thunder Energy Services LLC accepts no liability for any loss, damage, or personal injury arising from or in connection with the installation process. The installation manuals provided are intended for general guidance only and do not constitute professional advice. Customers must exercise their own judgement and ensure compliance with all applicable local regulations, building standards, and health and safety legislation. Where there is any uncertainty, customers are strongly advised to consult a suitably qualified professional.

 

Thunder Energy Services LLC shall not be held liable for any incorrect, unsafe, or non-compliant installation carried out by the customer or on the customer’s behalf.

11. Compliance with Export Regulation
 

You agree to comply with all applicable laws and regulations of the United Kingdom, and any other relevant jurisdictions, including all applicable export control laws and regulations (collectively, the “Export Regulations”).

You represent and warrant that any products or services purchased from this Site are for your own personal or household use only, and not for resale, transfer, or export. You further acknowledge that the products and services offered on this Site may be subject to export control laws, including but not limited to:

 

  • The UK Export Control Order 2008;

  • Regulation (EC) No 428/2009 of the European Union;

  • The Export Control Reform Act of 2018 (ECRA) (Title XVII, Subtitle B of Pub. L. No. 115-232);

  • The Export Administration Regulations (15 C.F.R. Parts 768–799);

  • The International Traffic in Arms Regulations (ITAR) (22 C.F.R. Parts 120–130); and

  • Any successor or supplemental regulations to the foregoing.

 

You agree that you will not export, re-export, divert, transfer, or disclose any products, services, software, or technical data obtained from Thunder Energy Services LLC to any destination, entity, or person prohibited under the Export Regulations, including but not limited to individuals or entities listed on the UK Sanctions List, the U.S. Department of Commerce Entity List, the Specially Designated Nationals (SDN) List, or any other restricted party lists maintained by relevant governmental authorities.

 

You are solely responsible for determining your compliance obligations under applicable Export Regulations, and Thunder Energy Services LLC accepts no liability for any breach of such laws resulting from your actions or omissions.

12. Intellectual Property Use and Ownership

You acknowledge and agree as follows:

 

  1. All references on this Site to the terms “sell,” “sale,” “resell,” “resale,” “purchase,” “price” and similar language refer to the grant of a license. Each product or service made available on this Site is licensed to you, not sold.

  2. You shall comply with all applicable terms and conditions relating to any product or service obtained through this Site, including, without limitation, obligations of confidentiality and restrictions on resale, use, reverse engineering, reproduction, modification, improvement, sublicensing, and transfer.

  3. You shall not encourage, facilitate, or permit any third party to breach the terms and conditions governing the use or licensing of any product or service provided through this Site, particularly as they relate to intellectual property rights.

  4. Thunder Energy Services LLC and/or its licensors shall retain all right, title and interest in and to the intellectual property rights associated with all products and services made available through this Site, including, without limitation, all copyrights, patents, trademarks, trade secrets, and any related documentation, specifications, or instructions. Nothing in these Terms grants you any ownership interest in or to such intellectual property rights. Your rights are limited strictly to the licence granted and subject to the restrictions set out herein.

13. Privacy

 

We respect your privacy and are committed to protecting your personal information. The collection, use, and processing of any personal data provided by you in connection with your purchase of products or services through this Site is governed by our Privacy Policy. You are encouraged to review the Privacy Policy carefully, as it forms an integral part of these Terms and Conditions.

14. Force Majeure

Neither party shall be liable or held responsible to the other, nor shall be deemed to have breached this Agreement, for any failure or delay in performing any of its obligations under this Agreement (excluding your obligation to make payments), to the extent that such failure or delay is caused by or results from events beyond the reasonable control of the affected party (the “Impacted Party”). Such events shall be deemed “Force Majeure Events” and may include, but are not limited to:

 

  1. acts of God;

  2. flood, fire, earthquake, epidemic, pandemic, explosion, or other natural disasters;

  3. war, invasion, acts of terrorism, armed conflict, or civil unrest (whether or not war is formally declared);

  4. acts, orders, laws or restrictions of any governmental authority;

  5. embargoes, blockades, or sanctions in effect after the date of this Agreement;

  6. national or regional emergencies;

  7. strikes, industrial disputes, lockouts, labour stoppages or slowdowns;

  8. failures of telecommunications, utilities or transport, power outages, lack of warehouse or storage availability, or inability to obtain adequate materials or supplies; and

  9. any other similar event or circumstance beyond the reasonable control of the Impacted Party.

 

The Impacted Party shall notify the other party in writing within ten (10) days of the Force Majeure Event, specifying the nature of the event and the expected duration. The Impacted Party shall use reasonable endeavours to mitigate the impact of the event, to resume performance as soon as practicable, and to minimise any resulting delay or disruption.

 

If the Force Majeure Event continues for a period of thirty (30) consecutive days after such notice is given, either party may terminate this Agreement by providing the other with not less than five (5) days’ written notice.

15. Governing Law and Jurisdiction

  1. These Terms, including any dispute or claim arising out of or in connection with them (including their interpretation, formation, performance, breach, or termination), shall be governed by and construed in accordance with the laws of the United Kingdom, excluding its conflict of law rules.

  2. The parties irrevocably agree that any legal action, suit, or proceeding arising out of or in connection with these Terms shall be brought exclusively before the courts of London, United Kingdom. Each party irrevocably submits to the exclusive jurisdiction of those courts for the purpose of any such legal proceedings.

  3. You agree to resolve any dispute with Thunder Energy Services LLC strictly on an individual basis. Neither you nor Thunder Energy Services LLC shall have the right to commence or participate in any claim brought as a class action, class arbitration, or other representative proceeding.

  4. If any provision of this clause relating to governing law and jurisdiction is held to be invalid or unenforceable, that provision shall be severed from the remainder of the clause, and the remaining provisions shall remain in full force and effect.
     

16. Assignment and Delegation

You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent. Any attempt to do so without such consent shall be null and void and of no effect.

 

For the avoidance of doubt, any unauthorised assignment or delegation shall not relieve you of your obligations under these Terms, all of which shall remain fully enforceable.

17. No Waiver

 

No failure or delay by us in exercising any right, power or remedy under these Terms shall operate as a waiver of that or any other right, power or remedy. A waiver of any provision or right shall only be effective if made in writing and signed by a duly authorised representative of Thunder Energy Services LLC. Any such waiver shall apply only to the specific instance and for the specific purpose for which it is given.

 

18. No Third-Party Rights

 

These Terms are intended solely for the benefit of the parties to them. Nothing in these Terms shall be construed as conferring any rights or benefits upon any third party, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

 

19.Notices

 

1. Notices to You. We may provide any notice under these Terms to you by:


(i) sending an email to the address you have provided to us; or
(ii) posting the notice on the Site.

 

Notices sent by email shall be deemed effective at the time of sending.

 

Notices posted on the Site shall be deemed effective upon posting. It is your responsibility to ensure that the email address provided is accurate and kept up to date.

20. Severability

 

If any provision or part of a provision of these Terms is held to be invalid, unlawful, void, or unenforceable for any reason, that provision shall be deemed severed from the remainder of the Terms. The validity and enforceability of the remaining provisions shall not be affected.

 

21. Entire Agreement

 

These Terms, together with your order confirmation, our Website Terms of Use, our Privacy Policy, and any other terms relating to the sale of specific products or services through the Site, constitute the entire agreement between you and Thunder Energy Services LLC in relation to the subject matter hereof. They supersede all prior agreements, understandings, or representations, whether written or oral, relating to such subject matter.
